Being Aware of Your Rights Regarding An Arizona Collection Company

By Greg Diener

In the state of Arizona many people from Tuscon to Phoenix to Glendale get faced with having to see their monthly credit collection bill and see that they owe a substantial amount of money. Since on occasion paying of a debt may take too long your original creditor will sell of any outstanding debts you might have to an Arizona Collection Company. When it reaches this point you want to be able to do research regarding these third-party agencies to ensure that these companies are operating fairly for you and that they keep your legal rights in mind.

Now when you start working with credit collection companies it is important you know what the business is required to do under the state law of Arizona. The company must not receive any fees unless you are required to pay the amount of your debt to them. A credit collection company is also not required unless with the consent of a lawyer to send you any letter in the mail which incites a legal action when it comes to the installment fees on your debt bill.

Regarding what credit collection agencies are not permitted to do in the state of Arizona you have to know about not only the rules in your state but also you want to note the rules in the Fair Debt Collection Practices Act (FDCPA). The FDCPA has been put into place since the 1970's and is responsible for helping protecting people from credit agencies who might use threatening or manipulative methods to get you to pay out the debt. Be aware that in Arizona credit agencies may not try on purpose to not deposit the money you have given for the debt payment after they received the money. Also note under Arizona law if your collection agency doesn't have an office located within state borders then they must be permitted to put the deposit in a place where the person holds a principal office.

About the FDCPA guidelines you need to know that these business are not permitted to call your home about your debt before the hours of 8:00 AM and after the hours of 9:00 PM. Third-party credit organizations may not be allowed to call your house after you have made it clear to them to quit calling you about the bill. Your name is not permitted under the FDCPA to be put onto a "bad debts" list to be sent to other companies. Before starting business with a third-party collection agency in Arizona be sure to work with a trusted company that can assist you in all your debt problems.

A last thing to remember is that should you receive a note from a collection agency about a bill you think that you already paid, know about the Arizona statute of limitations on the collection of debts. Arizona state law states that depending on the nature of the agreement or contract it can take anywhere from three-six years to pay out. The most important thing to remember is if you and the collection agency can co-exist and work around how you want to get your debt paid out, then it will be a trouble free procedure.
